A person dressed all in black walks down the middle of an unlit curvy country road - they're hit by a car and traumatically injured.

Blame can be shared in most incidents. It's the degree to which you blame each party that defines you as a person.

The car has headlights therefore it gets the majority of the blame

Car is too fast. Person has slower reaction.

I have a case now where a drunk guy dressed in dark clothes on a dark night stepped into the road and was killed. My client was the driver whose license was revoked but otherwise did not break any driving laws, wasn't drunk, wasn't speeding or anything. He stopped and called 911. Now he's charged because there's a law in Pennsylvania that if you cause a death when you're unlicensed, it's a felony even if you were not at fault.

The DA is being reasonable and is willing to settle for something less, but the victim's family is demanding "justice"...

There was another case in the news recently where this guy hit some person at night. He claimed he never get the person. I think it was because of their dark clothes but see the driver ended up leaving the scene and lying about what he knew before confessing. However, don’t be out at night in all black for goodness sakes. If it’s dark wear crap I can see. I already hate driving in darkness anyway.

I think we also have to question who's really the victim, the driver could just as easily get mental traumas from seriously injuring or killing a pedestrian who seemingly was willing to take all the risk in the world and who knows maybe even wanting to get hit.

Blame everyone, works for me.

You don't blame a victim for being a victim, blame him for being a moron.

But really accidents are 50/50 most of the time. If there is intent to harm, then of course you never blame the victim.
