The suit, filed in a Maryland court, alleges that Wal-Mart sold the CD – which did not have a parental-advisory sticker – knowing the profanity is used in one of the songs. Wal-Mart has cultivated an image, derided by some as being overly intrusive, of being a family friendly retailer by not selling albums with the warnings. According to the suit, filed by Maryland resident Trevin Skeens, Wal-Mart censored the song in question, Thoughtless, when it offered a free sample of the tune on its website. Skeens and his wife allowed their 13-year-old daughter to purchase the album, called Anywhere but Home, for her 13th birthday and were shocked when they listened to it on the drive home from the store. "I don't want any other families to get this, expecting it to be clean. It needs to be removed from the shelves to prevent other children from hearing it," the Associated Press reported Skeens saying. The suit seeks $74,500 U.S. in damages for each person who bought the album without knowing about the profanity. |

yes .. because the damage done is worth 74500 dollars. A) Wal-Mart should quit being so family friendly in its promotion cause it promotes shit like this B) Whatever happened to decency. What happened to the good ol days where you notice something wrong and go inform the people about it and give them a chance of fixing it, not finding every excuse in the world to sue someone and make some money out of it .. I'm sure people's horror over something wasn't big enough to warrant such a hefty amount! Can't expect someone to listen to every CD now, can you? |

Oh no, our children cannot ever listen to any songs that contain profanity, especially the dreaded f-word! It will warp their fragile minds. We can't teach them profanity, and we might as well cut out the outside world completely, or they'll become drug addicts who have sex at 13 and get drunk all the time. Idiots. |

I'm going with "stupid Wal-Mart" on this one. They are the idiots that took to santizing the records. They wouldn't be in this situation if they took that step to "guarantee" your music is sanitized. I love how hypocritical Wal-Mart is. You can buy a movie with nudity and swear words in it there, but they'll be damned if you'll get a CD with a naughty word. BUT, Wal-Mart created this environment by sanitizing the music and guaranteeing you pure music with no-swearing. Would this ever happen to Target? Hell no, they don't guarantee you pure clean, swear-free music. Bottom line, is that Wal-Mart would NOT be in this position to be sued if they didn't do assinine things like this. Sure the parents are jack-offs, but I hardly feel sorry for Wal-Mart considering their idiocy. I say anything that may make them re-evaluate this policy is ulimately a good thing. |

The family is perfectly right for suing Walmart here. By not putting the "Parental advisory" sticker on the CD, Walmart has implicitly advised the parents that there are no dirty words on the CD. Whether those parents deserve $75,000 (they don't) is irrelevant here; the court will award them some money, or they will settle with Walmart. In either case, it won't be as much as $75K. |
